After hearing oral argument, the appeals court judge denied the request and both sides were ordered to file written briefs. Judge Juan Merchan has found Trump has violated the gag order 10 times and fined him $10,000 for public statements Trump made about certain witnesses and the jury.

Donald Trump posted — and then quickly deleted — a statement Tuesday raging over the witness schedule and the judge in his criminal hush money trial. Trump fumed that prosecutors are not telling defense attorneys which witnesses they plan to call until the day before the witness testifies. "I have just recently been told who the witness is today. This is unprecedented, no time for lawyers to prepare," Trump wrote in the post. Prosecutor Joshua Steinglass told Merchan on Monday the Manhattan District Attorney's office is keeping its witness schedule hidden, in order to stop Trump from targeting people right before they take the stand.

He learned late Tuesday afternoon that Judge Aileen Cannon, whom he appointed, indefinitely postponed a trial in his classified documents case in Florida. She told the jury Tuesday about a $130,000 hush money payment she received from Cohen before the 2016 election. But prosecutors allege Trump falsified business records to hide it and to mislead voters in an early bout of election interference. The judge complained that the ex-president was “cursing audibly” during Daniels’ testimony and was shaking his head. “Am I correct that you hate President Trump?” Necheles asked.

New York CNN —A group of 13 conservative US federal judges are vowing to not hire Columbia University law students or undergraduates because of how the school has handled pro-Palestinian demonstrations on its campus in recent weeks. “As judges who hire law clerks every year to serve in the federal judiciary, we have lost confidence in Columbia as an institution of higher education. CNN has reached out to Columbia University for comment. They typically hire law school graduates for clerkships that can eventually lead to high-paying and prestigious jobs. If not, employers are forced to assume the risk that anyone they hire from Columbia may be one of these disruptive and hateful students,” the judges wrote.

Merchan told Blanche they were speaking at the bench because the judge did not want to embarrass Trump. “One time I noticed when Ms. Daniels was testifying about rolling up the magazine, and presumably smacking your client, and after that point [Trump] shook his head and he looked down. Blanche said he would talk to Trump during the break. Daniels then told jurors that she “spanked” a “rude, arrogant and pompous” Trump “right on the butt” with a copy of one of his magazines.
